PET BOARDING AND/OR DAY CARE AGREEMENT

THIS PET BOARDING AND/OR DAY CARE AGREEMENT ("Agreement") is made and entered into as of the last date stated, by and between K-9 Secured and the Pet Owner set forth below ("Pet Owner").

SERVICES: K-9 Secured provides dog boarding, dog daycare, drop- ins and bathing services. Pet Owner hereby engages K-9 Secured to provide the services for his or her pet(s) on the terms and conditions set forth in this Agreement and in any supplemental pet information or reservation forms provided.

PET OWNER REPRESENTATIONS; DUTY TO DISCLOSE. Pet Owner represents and warrants to K-9 Secured that:
A: Pet Owner is the rightful owner or caretaker of the pet, and his or her acknowledgment and payment is sufficient to enter into this Agreement for, and on behalf of, any other owner or representative of the pet.
B: The pet is current on all required vaccinations. Pet Owner agrees to provide documents confirming such vaccinations as requested by K-9 Secured in order to provide services.

ACCEPTANCE OF RISK. Pet Owner acknowledges and agrees that his or her pet may be permitted to interact and play with other dogs and K-9 Secured staff. Pet Owner acknowledges that when dogs play in groups that nicks or scratches may occur, and K-9 Secured may or may not notify Pet Owner immediately if the pet sustains any nicks, bites or scratches.Pet Owner further acknowledges that animals are unpredictable and that there is a possibility of injury to the pet or to another animal or person.Therefore, as consideration of the services rendered by K-9 secured, Pet Owner
(A) hereby waives and releases K-9 Secured, and its managers, owners, & employees from any and all claims, actions, damages or liability for injury, sickness or illness suffered by his or her pet while in the care of K-9 Secured or otherwise relating to the care, control, health and/or safety of the pet arising from pick up, transport, drop off and/or stay at K-9 Secured, except to the extent such illness or injury is the result of K-9 Secured's gross negligence or intentional misconduct.

(B) agrees not to initiate any legal proceedings against K-9 Secured with respect to such released claims. "Sickness and illness" shall be defined to include any illness, including, without limitation, bordetella (kennel cough) or any other form of contagious illness.

INDEMNIFICATION; LIABILITY. AS CONSIDERATION FOR THE SERVICES RENDERED BY K-9 SECURED, PET OWNER WILL INDEMNIFY, DEFEND AND HOLD K-9 SECURED AND K-9 SECURED PARTIES HARMLESS FROM AND AGAINST ANY AND ALL LOSSES, LIABILITIES, DAMAGES, FINES, PENALTIES AND EXPENSES (INCLUDING ATTORNEYS' FEES AND VETERINARY COSTS AND EXPENSES) ARISING FROM OR RESULTING FROM ANY BREACH OF THE REPRESENTATIONS, WARRANTIES OR COVENANTS CONTAINED IN THIS AGREEMENT (INCLUDING ABANDONMENT OF THE PET AT THE COMPANY FACILITY), OR OTHERWISE RELATED TO ANY AND ALL ACTS OF BEHAVIOR OF THEIR PET(S), WHICH MAY INCLUDE, WITHOUT LIMITATION, INJURY OR DEATH TO A PET OR ANIMAL AT THE FACILITY OR INJURY OR DEATH TO A STAFF MEMBER OF COMPANY OR ANY OTHER MEMBER OF THE PUBLIC. IN NO EVENT WILL COMPANY OR ANY COMPANY PARTY BE HELD LIABLE FOR SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, EVEN IF ADVISED OF THEIR POSSIBLE EXISTENCE.​

​EVALUATION; K-9 Secured requires an evaluation of pet(s) prior to engaging in dog boarding. Proof of current vaccinations are required prior to evaluation. After evaluation is complete, K-9 Secured reserves all rights to refuse to provide pet care services for any reason in their sole and absolute discretion.Further, Pet Owner understands participation in play time is at the discretion of the handlers, and the pet may be separated from other pets or asked to leave for any reason under K-9 Secured's sole discretion.

PAYMENTS AND CANCELATION: Deposit is due to secure boarding over 300$. Deposit is non refundable. Deposit is 1/2 the total price, unless stated otherwise. Full amount due by date posted to secure stay. Bookings are based on first come first serve. Your booking is finalized once invoice total is paid. If there is an outstanding balance after the due date on the invoice, your reservation will potentially be voided and given to the next guest.

Cancelations within 7 days prior to start date are non refundable. If you cancel prior to the 7 day window, the amount paid outside of the deposit, will go towards a future stay with K-9 Secured.

Cancelations made by K-9 Secured can be refunded or credited to your account including deposits.

Cancelations due to disaster or hurricane will be refunded or credited to your account in the amount outside of the deposit.

ABANDONED PETS: Pet Owner understands and agrees that if their pet is not picked up within seven (7) calendar days after the scheduled pick up date, the pet shall be deemed to be abandoned and additional boarding charges shall apply, and in such event, K-9 Secured shall gain legal custody and ownership of the pet and retain the right to keep the pet, or place the pet in a shelter or with animal control, with no recourse by Pet Owner against K-9 Secured.

VETERINARIAN LIABILITY AND CARE. In the event that Pet Owner's pet should need veterinary services while in the care of K-9 Secured, Pet Owner request that the following conditions be adhered to: Save my pet regardless of the cost of any necessary treatment, medication, or surgical procedures once approved by Pet Owner. Use any and all reasonable and customary treatments, medications, surgical procedures necessary to treat my pet, not to exceed 1000$ if Pet Owner cannot be contacted. Pet owner is responsible for full cost of such medical treatment.

Medical Emergency Information: If a pet passes away at the Company's facility, it will be brought to its or the nearest veterinarian. PET OWNER AGREES THAT PET OWNER IS FULLY RESPONSIBLE FOR THE COST OF ANY SUCH MEDICAL TREATMENT.

PHOTOS AND VIDEO RELEASE: Pet Owner agrees to allow K-9 Secured to use his or her pet's name and any images or likeness of his or her pet taken while the pet is under care with K-9 Secured, in any form, for use, at any time, in any media, marketing, advertising, or promotional materials.

PET OWNER HAS READ AND FULLY UNDERSTANDS THE TERMS OF THIS AGREEMENT, INCLUDING THE RELEASES, WAIVERS OF LIABILITY, ACCEPTANCE OF RISK AND INDEMNITY PROVISIONS AND UNDERSTANDS THAT PET OWNER HAS AGREED FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT, ASSURANCE OR GUARANTEE AND INTENDS IT TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT PERMITTED BY LAW.

Hurricane Policy

In the event of a hurricane, K-9 Secured will comply with evacuation orders issued by Pinellas County. Our location is Zone D and may not provide adequate protection in the event of a disaster. All boarding pets must be evacuated. Therefore, it is required during the season, you, the Pet Owner will provide us with the name, and phone number of the person responsible for picking up your pet from our location as K-9 Secured is not responsible for evacuation of your pet. In the event of a mandatory evacuation, if you cannot return to do so within 4 hours of first notification, we will notify the emergency contact that they will be responsible for pick up. Our location is in zone D but will notify Pet Owner in advanced to arrange pick ups.

Pet Owner has agreed to provide accurate contact information for an emergency contact. Pet Owner realizes K-9 Secured may not have the ability to remain on site in the event of an evacuation. Pet Owner assumes all financial responsibility and agrees to hold K-9 Secured harmless in its efforts to care for my pet, if my pet is not evacuated by Pet Owner or emergency contact listed in the event of a disaster. Pet owner understands every reasonable effort will be made to keep my pet safe.

Drop ins: Drop in services will be canceled in the event the county issues evacuation orders for, but not limited to, K-9 Secured's location and/ or the pet owners home.
